Much controversy has emerged on the demarcation between legal positivism and non-legal positivism with some authors calling for a ban on the -as they see it- nonsensical labelling of legal philosophical debates. We agree with these critics; simplistic labelling cannot replace the work of sophisticated and sound argumentation. In this paper we do not use the term ‘legal positivism’ as a simplistic label but identify a specific position which we consider to be the most appealing and plausible view on legal (...) positivism. This is the view advocated by Gardner in his paper 'Legal Positivism: 5½ Myths’, where he carefully scrutinises the most convincing and unifying postulates of legal positivism, which he calls “the thin view”. The study shows that this thin view presupposes an empirical conception of action that is untenable and implausible since it makes acts of engagement with the law unintelligible to an observer of such acts. The variety of devices and the socialization of consumption have decentralized access to online information which is not retrieved directly from media websites but through social networks. These same factors have driven user interest towards a wider range of both ‘hard’ and ‘soft’ topics. The aim of this article is to identify the consumption of news on these topics among digital users in Spain. The methodology used is based on an analysis of the survey conducted as part of the Digital (...) News Report 2017. Following this analysis, a conclusion has been reached that the most popular hard news stories in Spain are those related to the local and regional community itself, and to health and education, while the most popular soft news stories relate to lifestyles and arts and culture. The analysis has revealed that increased interest in news and greater topic specialization result in more diversified use of sources, formats, and complementary routes. (shrink)

We question two conceptual assumptions made by Niedenthal et al.: the dichotomy between true and false smiles and the close tie between recognition and experience of emotion. An excessive dependence on everyday language suggests overly parsimonious accounts of a complex set of relations between smile, experience, and context.

We conducted three studies aimed at showing that one-to-one translations between emotion terms might be comparing independent or barely overlapping categories of emotional experience. In Study 1 we found that the speakers' most accessible features of two supposedly equivalent emotions terms (shame and vergüenza) were very different. In Study 2, American and Spanish speakers' typicality ratings of 25 out of 29 constitutive features of “shame” or “vergüenza” were significantly different. In Study 3, these important differences in the content and internal (...) structure of “shame” and “vergüenza” were also reflected in the affective meaning of their corresponding terms. We conclude that “shame” and “vergüenza” do not share the same cluster of central features, and cannot be treated as identical categories of emotional experience. This finding raises serious questions about the one-to-one translation practices not only of most cross-cultural studies on “shame”, but also of other emotion concepts. We suggest an alternative method of translation based on Diachronic Prototype Semantics (Geeraerts, 1997). (shrink)

Introduction: Traditionally, empathy has been studied from two main perspectives: the theory-theory approach and the simulation theory approach. These theories claim that social emotions are fundamentally constituted by mind states in the brain. In contrast, classical phenomenology and recent research based on enactive theories consider empathy as the basic process of contacting others’ emotional experiences through direct bodily perception and sensation. Objective: This study aims to enrich knowledge of the empathic experience of pain by using an experimental phenomenological method. Method: (...) Implementing an experimental paradigm used in affective neuroscience, we exposed 28 healthy adults to a video of sportspersons suffering physical accidents while practicing extreme sports. Immediately after watching the video, each participant underwent a phenomenological interview to gather data on embodied, multi-layered dimensions (bodily sensations, emotions, and motivations) and temporal aspects of empathic experience. We also performed quantitative analyses of the phenomenological categories. Results: Experiential access to the other person’s painful experience involves four main-themes. Bodily resonance: participants felt a multiplicity of bodily, affective, and kinesthetic sensations. Attentional focus: some participants centered their attention more on their own personal discomfort and sensations of rejection, while others on the pain and suffering experienced by the sportspersons. Kinesthetic motivation: some participants experienced the feeling in their bodies to avoid or escape from watching the video, while others experienced the need to help the sportspersons avoid suffering any injury while practicing extreme sports. Temporality of experience: participants witnessed temporal fluctuations in their experiences, bringing intensity changes in their bodily resonance, attentional focus, and kinesthetic motivation. Finally, two experiential structures were found: one structure is self-centered empathic experience, characterized by bodily resonance, attentional focus centered on the participant’s own experience of seeing the sportsperson suffering, and self-protective kinesthetic motivation; the other structure is other-centered empathic experience, characterized by bodily resonance, attentional focus centered on the sportsperson, and prosocial kinesthetic motivation to help them. Discussion: We show how phenomenological data may contribute to comprehending empathy for pain in social neuroscience. In addition, we address the phenomenological aspect of the enactive approach to the three dimensions of embodiment of human consciousness, especially the intersubjective dimension. AntecedentsPrevious research on citizens’ reactions after terrorist events has shown that positive reactions can also emerge alongside pain and horror. Positive emotions have been widely associated with an abstract style of thinking. In the context of the Paris terrorist attacks in 2015, we explored Spanish citizens’ positive reactions – empathic concern, positive emotional climate, and esteem for humanity – and examined the relationships of these responses with an abstract style of thinking.MethodA longitudinal study was designed involving an online questionnaire that (...) was administered 10 days, 3 weeks, and 2 months after the attacks.ResultsEmpathic concern and personal distress toward Parisians decreased from the weeks following the attacks to 2 months later, with empathic concern always being more intense than personal distress. Emotional climate was perceived as more hostile than positive, although positive feelings persisted. People reported moderately positive esteem for humanity. Individuals with a more abstract style of thinking reported greater empathic concern, a more positive emotional climate, and more esteem for humanity.ConclusionsOur results support and extend previous research showing that abstraction enhances people’s resilience, even under traumatic circumstances such as those surrounding a terrorist attack. Durante los últimos decenios, viene ganando terreno un modelo de uni-versidad basado en el management, en detrimento de la universidad humboldtiana, erigida sobre pilares humanísticos. Esta situación nos interpela con vehemencia: ¿qué lugar deberían ocupar las humanidades en las universidades actuales? El presente trabajo intentará contri-buir a este interrogante desde una perspectiva en particular, a saber: ¿qué puede aportar la enseñanza de la ética filosófica a estudiantes de carreras científicas y tecnológicas?

The current study analyzed the relationship between Coronavirus Awareness, mental health, and willingness to seek professional psychological help. This was made through a quantitative approach, using online questionnaires to collect data from 855 subjects. The questionnaires included the Brief Symptom Inventory to measure mental health indicators, the Attitudes Toward Seeking Professional Psychological Help Scale–Short Form, and the Coronavirus Awareness Scale-10. An Exploratory Factor Analysis suggests that three factors underlie the CAS-10: Coronavirus Concern, Exaggerated Perception, and Immunity Perception. Results indicate a (...) significant positive correlation between Coronavirus Concern and both general anxiety and phobic anxiety symptoms. Immunity Perception is positively related to paranoid ideation and psychotic symptoms. A Mediation Analysis determined that Coronavirus Concern has a significant positive direct effect on Openness to Seeking Psychological Treatment, while Exaggerated Perception and Immunity Perception scores have significant direct negative effects on the Value and Need in Seeking Treatment scores. Indirectly, the relationship between Coronavirus Concern and OPST is significantly mediated by anxiety symptoms. Similar results were found for the VNST subscale. There is a negative significant effect of Immunity Perception over OSPT mediated by Paranoid Ideation. However, the overall model only achieved small r2 coefficients for the OSPT and VNST scores. Comparisons in Coronavirus Awareness between sex, age, and the presence of children and older adults at home were also made. These results are discussed regarding their practical implications for mental health providers and policymakers. (shrink)

In this paper I propose to conceive of forgiveness as a process of eliminating punitive reactive attitudes, which makes up part of the offended person’s willingness to reestablish a certain type of reciprocal relationship with the offender. Distinguishing among types of reciprocity allows us to realize that forgiveness is a more varied phenomenon than is usually assumed in the philosophical literature, as well as to understand why the dispute concerning the gratuitousnessconditionality of forgiveness is meaningless.

Human genomics is a translational field spanning research, clinical care, public health, and direct-to-consumer testing. However, law differs across these domains on issues including liability, consent, promoting quality of analysis and interpretation, and safeguarding privacy. Genomic activities crossing domains can thus encounter confusion and conflicts among these approaches. This paper suggests how to resolve these conflicts while protecting the rights and interests of individuals sequenced. Translational genomics requires this more translational approach to law.

I am referring to the interdisciplinary research group Histopia, which has its base in Madrid́s (...) Autónoma University, is comprised of twenty-seven researchers from different institutions, and is coordinated by historian Juan Pro. As the name Histopia suggests, it was founded by historians. From the beginning there have been people from other fields, such as political science, architecture, cultural studies, and art history. The aim was always understanding utopianism beyond the study of texts, and centering research in everything that utopianism produces, such as social movements, political programs, and urban programs. In this sense, a premise was to understand utopias not as a footnote in history or a series of eccentric events, but as a guiding force that drives a [End Page 510] history. This placing of utopianism in history was clearly announced in the grouṕs website:Histopia seeks to go beyond the philological approach that predominates in Utopian Studies and to historicize the study of contemporary utopias and dystopias, showing how they respond to the contexts in which they arise, since they reflect the problems and frustrations of a society as well as the aspirations for change it contains, and the conditions of possibility that a particular cultural and emotional framework offers for developing them.1Together with this focus on history, which departs from the more text-centered traditions of an important part of utopian studies, the other main particularity of Histopia is its decentralizing of utopian studies towards the Spanish-speaking world. Uterus transplantation (UTx) research has been introduced in several countries, with trials in Sweden and the United States producing successful outcomes. The growing interest in developing UTx trials in other countries, such as Spain, the Netherlands, Japan, and Australia, raises important questions regarding the ethics of surgical innovation research in the field of UTx. This paper examines the current state of UTx in the context of the surgical innovation paradigm and IDEAL framework and discusses the ethical challenges faced by those (...) considering the introduction of new trials. We argue that UTx remains an experimental procedure at a relatively early stage of the IDEAL framework, especially in the context of de novo trials, where protocols are likely to deviate from those used previously and where researchers are likely to have limited experience of UTx. We conclude that countries considering the introduction of UTx trials should build on the strengths of the reported outcomes to consolidate the evidence base and shed light on the uncertainties of the procedure. Authorities responsible for the ethical governance of UTx trials are advised to draw on the ethical framework used in the oversight of surgical innovation. (shrink)

ABSTRACT My aim in this paper is to present a pluralist thesis about the inferential role of logical constants, which embraces classical, relevant, linear and ordered logic. That is, I defend that a logical constant c has more than one correct inferential role. The thesis depends on a particular interpretation of substructural logics' vocabulary, according to which classical logic captures the literal meaning of logical constants and substructural logics encode a pragmatically enriched sense of those connectives. The paper is divided (...) into four parts: first, I introduce the motivation for the pluralist thesis of the paper; second I introduce the calculus for the different logics endorsed in the pluralist thesis; third, I motivate how the different behaviors of the logical vocabulary of these logics can be pragmatically interpreted, and fourth, I motivate how the different inferential roles that each substructural logic attribute to logical constants can coexist, and how we should reason with a logical constant c given this plurality. We axiomatize the corresponding theory and we show that it is complete and that it admits quantifier elimination in the usual module language augmented with additive functions which are the analog of the $p$-component functions.

Pour les Dormeuses et les Méditateurs, l’anachronisme est placé au centre de leur discours artistique et de leur pratique vitale. En s’habillant en Grecs et en vivant en communauté à la périphérie de la ville, ils tentent d’incarner leur vision idéalisée de l’Antiquité. Par leur absence de fidélité historique, ils ouvraient également un espace d’expérimentation sociale. Ce texte soulève donc la possibilité d’utiliser l’anachronisme comme outil pour débloquer l’imagination politique et imaginer de nouveaux horizons collectifs.

Después de un breve repaso de un libro de Jorge Wagensberg sobre la experiencia del gozo intelectual, aludo al fenómeno contrario: el pensamiento sombrío y el pesimismo. Después, remarco la defensa de Spinoza del gozo del conocimiento y su poder contra la tristeza y el pesimismo. Finalmente, analizo el peculiar gozo intelectual en Spinoza y conecto este gozo con la experiencia de eternidad y su expresión a través de categorías espaciales.

SPANISH: Las siguientes páginas tienen por finalidad dilucidar el proceder heideggeriano denominado «destrucción» o «desmontaje» [destruktion]. Esto se lleva a cabo, en primer lugar, poniendo en claro qué quiere decir, para el Heidegger de los años veinte, el término “destrucción” y cuál es su relevancia filosófica, a partir de la exposición de aquellos anclajes que fundan su necesidad y la sustentan. En segundo lugar, se ejemplifica el proceso destructivo, de la mano del desmontaje de lo que el autor llama la (...) «conciencia filosófica». Finalmente, realizamos una exposición de los resultados del proceso de desmontaje e intentamos apropiarnos del sentido filosófico más profundo de la destrucción. The stream on political corporate social responsibility argues that companies have recently assumed state-like roles to influence global governance. However, following emerging calls for greater contextualization of CSR, we trace the historic evolution of PCSR in the case of Colombia and argue that such political engagement by firms is not new. Looking beyond a linear chronological account, we reveal the sedimentation process behind PCSR by exploring the archetypical political roles businesses have taken on in providing public goods and acting as (...) regulators, and chart their transformation. Our findings allow us to make two main contributions. First, by unearthing different strata of business and society relations, we enrich the research on PCSR, highlighting its historical sedimentation dynamics. By integrating institutional and historical perspectives, we respond to calls for complementary accounts of one of the premises found in the literature that considers globalization as the starting point of PCSR. Second, our exploration of the past and present of PCSR in Colombia provides scholars and practitioners with an overview of the complex state and stakes of CSR in that country. We also discuss the implications of sedimentation for PCSR theory and future research directions. (shrink)

A wide array of species throughout the animal kingdom has shown the ability to distinguish between quantities. Aside from being important for optimal foraging decisions, this ability seems to also be of great relevance in group-living animals as it allows them to inform their decisions regarding engagement in between-group conflicts based on the size of competing groups. However, it is often unclear whether these animals rely on numerical information alone to make these decisions or whether they employ other cues that (...) may covary with the differences in quantity. In this study we used a touch screen paradigm to investigate the quantity discrimination abilities of two closely related group-living species, wolves and dogs, using a simultaneous visual presentation paradigm. Both species were able to successfully distinguish between stimuli of different quantities up to 32 items and ratios up to 0.80, and their results were in accordance with Weber's law (which predicts worse performances at higher ratios). However, our controls showed that both wolves and dogs may have used continuous, non-numerical cues, such as size and shape of the stimuli, in conjunction with the numerical information to solve this task. In line with this possibility, dogs' performance greatly exceeded that which they had shown in other numerical competence paradigms. We discuss the implications these results may have on these species' underlying biases and numerical capabilities, as well as how our paradigm may have affected the animals' ability to solve the task. In this paper we mainly study preservation theorems for two fragments of the infinitary languagesLκκ, withκregular, without the equality symbol: the universal Horn fragment and the universal strict Horn fragment. In particular, whenκisω, we obtain the corresponding theorems for the first-order case.The universal Horn fragment of first-order logic (with equality) has been extensively studied; for references see [10], [7] and [8]. But the universal Horn fragment without equality, used frequently in logic programming, has received much less attention from the model (...) theoretic point of view. At least to our knowledge, the problem of obtaining preservation results for it has not been studied before by model theorists. In spite of this, in the field of abstract algebraic logic we find a theorem which, properly translated, is a preservation result for the strict universal Horn fragment of infinitary languages without equality which, apart from function symbols, have only a unary relation symbol. This theorem is due to J. Czelakowski; see [5], Theorem 6.1, and [6], Theorem 5.1. A. Torrens [12] also has an unpublished result dealing with matrices of sequent calculi which, properly translated, is a preservation result for the strict universal Horn fragment of a first-order language. And in [2] of W. J. Blok and D. Pigozzi we find Corollary 6.3 which properly translated corresponds to our Corollary 19, but for the case of a first-order language that apart from its function symbols has only oneκ-ary relation symbol, and for strict universal Horn sentences. The study of these results is the basis for the present work. In the last part of the paper, Section 4, we will make these connections clear and obtain some of these results from our theorems. In this way we hope to make clear two things: (1) The field of abstract algebraic logic can be seen, in part, as a disguised study of universal Horn logic without equality and so has an added interest. (2) A general study of universal Horn logic without equality from a model theoretic point of view can be of help in the field of abstract algebraic logic. (shrink)

Se presenta en este trabajo la encrucijada actual de la interpretación de la novela más célebre de Gabriel García Márquez dando cuenta, por un lado, de una tradición interpretativa que desde una cierta idea de “lo nacional” relaciona el sentido de la obra con un agotamiento de la historia y, por otro lado, postulando las condiciones de posibilidad de otra interpretación, vale decir, otra tradición interpretativa desde donde leer la novela para hallar en ella otro sentido con relación a la (...) historia.
